By registering as a user on Miodel, I accept the following conditions:

Privacy Policy

Miodel considers strictly confidential, and refrains from revealing to any other person or organization the personal information obtained through the use of our services, such as the creation and management of client accounts that are outside the public domain and without prior consent, except in the case where we have to comply with law enforcement. The information that we consider confidential in relation to this policy is the following:

  • Your first names, middle names, and last names
  • Your postal address
  • Your telephone number
  • Your email address
  • Your access data: username and password
  • The information required for identification in order to recover the username and/or password
  • Your location
  • The identity of your device
  • The content of your communications with us (written or verbal)
  • When this is given as free text, the following is also considered personal information

  • Your date of birth
  • Your particular signs or your physical description
  • Your confidential and sensitive information, including your religion, gender, political affiliations, sexual orientation, race, or medical information
Miodel has the obligation to cooperate with the competent law enforcement authorities regarding the disclosure of confidential information if we consider that the request or warrant emanates from a relevant court of justice and that it does not, in any way, violate the laws in force and the freedoms of the interested party.

How your information is used

When you share your data with us, we store it on our secure servers to provide you with our services and/or fulfill your requests. Your data is kept for the duration of your account activity and is deleted when your account is ceased, unless otherwise requested.

Only information necessary for the provision of the service is collected and is never shared between our different services. This means that if you consume more than one of our services, each set of information is kept separate and is subject to the corresponding retention policies.

Identification

Your information is used to identify you on our platforms and/or when you communicate with us. Your data is visible to Miodel personnel who are qualified and for whom access has been granted.

Analytics

We use some of your anonymous information to produce reports that allow us to better manage our services.

Communication

If we need to contact you for a particular reason, for example to confirm an order, we will use the contact details you have shared with us. In the process, we shall endeavour to update any incorrect information as soon as we notice an error.

Marketing

Your information is never shared with or sold to third-party organisations for commercial purposes, but we occasionally use your contact information to notify you of promotions and special offers through targeted marketing campaigns.

You can opt out from receiving marketing material and notifications at any time either by letting us know or by disabling notifications in your device.

Cookies

The application collects some information that provide us with "usage data", such as the number of visits or screens navigated to. This data helps us to analyse and improve the service we provide to you. Usage data is anonymous and is aggregated for analysis purposes.

We also collect session information and other settings from your device to facilitate and track page navigation. These data are transient and are automatically removed.

Retention and deletion of your information

We only store and process your information for legitimate reasons and to provide you with our services. We keep your data as long as your services remain active. Your information is deleted after the deletion of your account, except in cases of disputes, handling of complaints or if it is explicitly requested. Miodel considers the following reasons to store and process your data as legitimate:

  • As long as your services are active
  • In case of debt collection procedures
  • In the event of a complaint handling procedure
  • Request from the competent legal authorities to maintain the data beyond the period that satisfies our definition of legitimacy
  • If the user explicitly requests it

Securing your information

All of our services are protected by SSL technology, which means that any connection made to one of Miodel's sites or applications is encrypted and cannot be decoded or read by unauthorized people or programs.

Your information is stored on secure servers and is protected by a server redundancy mechanism that guarantees 99.99% availability, thus eliminating the possibility of data loss.

My Responsibilities

  • My personal data will be stored on Miodel's servers and will remain so for as long as my account is active.
  • I must ensure that my personal data is kept up to date.
  • Once my account is terminated, my personal information will be deleted immediately, unless otherwise required by law.
  • As a customer, and where appropriate, I am responsible for providing information about my allergies and food intolerances. Therefore, I accept that Miodel is in no way responsible for the medical consequences that result if I do not provide information related to allergies and food intolerances when placing an order.
  • I understand that Miodel reserves the right to cancel my account and to alert the competent authorities if it turns out that my account is fictitious and / or I abuse the service. Examples of behavior considered abusive include:
    •       Failure to pay the invoice upon delivery.
    •       Failure to receive orders repeatedly.
    •       Assault of any form (physical or verbal) towards Miodel staff (including independent delivery crews)
    •       Breach of the code of conduct, for example, use of profane or illegal language
  • When I leave comments or requests as free text, I agree not to include any language that could be deemed offensive, violent, racist, vulgar, or related to a criminal activity. I accept that if I break the law, I may be committing an offense.
  • I understand that Miodel may, in certain cases, use my personal data to identify me in accordance with the privacy policy.
  • When placing an order through Miodel, I agree to honour the payments indicated in the order summary. Failure to do so would lead Miodel to initiate debt recovery procedures which may also lead to the closure of my account.

My Rights

  • As a customer, I have the right to raise issues to Miodel, who will ensure that my complaints are taken seriously and will inform me of the progress of my complaints.
  • In the unlikely event of a data breach, I expect Miodel to inform me no later than 72 hours from detecting such a breach.
  • I understand that Miodel may act as an intermediary between me, the client, and the store from which I place my orders. As such, I expect that Miodel will pass on my comments and complaints to the end seller and keep me informed of progress.
  • I expect that Miodel to commit to respecting the delivery times confirmed when placing the order.
  • Miodel is committed to informing me in a timely manner if my order is subject to changes or delays.
  • I reserve the right to return an order if I receive a different list to the one I ordered.
  • I am entitled to a full refund for any justified returns.

Terms of Use & Service Limitations

  • Miodel may update these Terms at any time. Users will be informed of any significant changes. Continued use of the platform implies acceptance of the updated Terms.
  • Miodel reserves the right to suspend, limit, or terminate access to the service at any time, especially in the case of abuse, technical failures, or force majeure.
  • The service is provided “as is” and “as available” without any guarantees regarding uptime, performance, or availability in all regions.
  • Miodel shall not be held responsible for losses, damages, or claims arising from issues related to third-party providers, technical interruptions, or failures beyond its control.

Subscriptions and Billing

  • Miodel may offer recurring delivery subscriptions. Subscriptions renew automatically unless cancelled before the renewal date.
  • By subscribing, I authorize Miodel to charge my selected payment method at each billing cycle until I cancel the subscription.
  • Subscription cancellations can be made at any time through the app or by contacting support. No partial refunds will be issued for unused periods unless legally required.
  • Miodel reserves the right to change subscription pricing with advance notice.

Governing Law and Dispute Resolution

These Terms of Service are governed by and interpreted in accordance with the laws of Spain, without prejudice to any mandatory legal protections granted to consumers under the laws of their country of residence.

We strive to resolve any issues quickly and amicably. If a dispute arises and cannot be resolved informally, it may be brought before the courts of Seville, Spain. However, if required by applicable law, you may also bring the dispute before the courts in your country of residence.

In some cases, and where mutually agreed, alternative dispute resolution methods (such as mediation or arbitration) may be used.

This clause applies to all users of our service, regardless of country, and shall not limit any non-waivable consumer protections provided under local laws.

Intellectual Property

All content on Miodel's platform, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Miodel or its content suppliers and protected by international copyright, trademark, and other intellectual property laws. Users may not reproduce, distribute, modify, or use any of Miodel’s content without explicit written permission.

Limitation of Liability

To the fullest extent permitted by applicable law, Miodel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, arising out of or in connection with the use or inability to use the service.

Miodel takes care to label all ingredients clearly and transparently. As such, Miodel shall not be held liable for any allergic reactions, intolerances, or other medical complications arising from the consumption of products by users with known or unknown allergies.

Account Termination

Users may terminate their account at any time by contacting customer support or using the account settings. Upon termination, all personal data will be deleted in accordance with the retention policy unless otherwise required by law. Miodel also reserves the right to terminate accounts that violate the Terms of Service.

Force Majeure

Miodel shall not be held liable for any failure or delay in performance of its obligations under these Terms caused by events beyond its reasonable control, including but not limited to natural disasters, war, terrorism, strikes, government action, network or infrastructure failures, or pandemics.

International Use and Jurisdiction

Miodel is based in Spain and operates under Spanish law. The platform may be accessed in other jurisdictions, and users are responsible for compliance with local laws. Where local laws grant additional consumer rights, such rights shall be respected. Miodel does not restrict its services to the EU and reserves the right to expand or limit availability in specific countries as needed.
